The High Court today (March 11) issued a rule asking government officials to explain why the provision allowing a parliament speaker to administer the oath of office to a president should not be declared authoritarian and unconstitutional.
The law ministry senior secretary, cabinet secretary and Supreme Court registrar general have been given eight weeks to explain why the provision, under a 2011 constitutional amendment, should not be scrapped.
Justice A K M Asaduzzaman and Justice Syed Enayet Hossain issued the ruling in response to a writ petition filed by lyricist Shahidullah Farayezi the previous day.
During today’s hearing, Advocate Omar Faruk moved on behalf of the petitioner while Deputy Attorney Generals Md Jasim Sarker and Rasel Ahmmad represented the state.
