The Appellate Division of the Supreme Court (SC) will hear a review petition of 1,137 job seekers on a High Court verdict cancelling the first viva of the 27th BCS examinations which it upheld later.
The hearing of the review petition will be held on December 4 next.
A four-member bench, led by Chief Justice Syed Refaat Ahmed passed the order on Thursday.
In 2007, the Bangladesh Public Service Commission (PSC) cancelled the first viva voce examination of the 27th BCS examination during the caretaker government regime. The cancellation followed charges of gross irregularities of the PSC on several occasions, especially question leaks and corruption centring the viva voce in which 3,567 candidates succeeded. Later, some candidates filed a writ petition challenging the PSC decision.
The High Court division bench of Justice M Abdur Rashid and Justice M Ashrsful Islam on July 3, 2008, declared the PSC decision legal and allowed the government recruiter to arrange a second viva. A total of 3,229 job seekers passed the second viva and they joined the service.
This time, a group of candidates, including M Sohel Rana, filed another writ, which let the division bench of Justice Meftah Uddin Chowdhury Rumi and Justice AB Siddiqui declare the second viva illegal again.
In 2010, the Appellate Division upheld the High Court verdict canceling the first viva of the 27th BCS examinations.
The court also issued an order settling another writ plea seeking cancellation of the second viva and made some observations.
