BNP Chairman Tarique Rahman was elected from the Bogura-6 constituency and Dhaka-17 constituency in the February 12 elections. According to the Representation of the People Order, one cannot be a member of parliament from more than one constituency at the same time. Therefore, when he expressed his intention to vacate the Bogura-6 constituency on Monday (February 16), the EC declared the seat vacant.
According to the constitution, if a seat in the National Assembly is declared vacant, a by-election has to be held within 90 days.
On the other hand, the commission postponed the election for Sherpur-3 constituency in the February 12 election as a valid candidate died, as per the RPO. According to the law, the election for this constituency will have to be held by announcing a new schedule. In this case, those who were valid candidates earlier will not have to file their nomination papers again.
