The High Court has dismissed the writ filed seeking postponement of all activities of the upcoming 13th National Assembly elections on the grounds that it was not raised.
A bench headed by Justice Shikder Mahmudur Razi delivered the order in the High Court on Monday. Advocate Yarul Islam was in favor of the writ in the court.
Earlier, a writ was filed on December 3 seeking postponement of all activities of the upcoming 13th National Assembly elections. The writ seeks to declare the appointment of the secretary, returning officer and assistant returning officer of the Election Commission from the Executive Division illegal and to direct the formation of the Electoral Service Commission.
The writ seeks a rule and seeks to suspend all activities of the upcoming National Assembly elections until the rule is settled.
Advocate Yarul Islam, secretary general of the registered political party Bangladesh Congress, filed the writ. Chief Election Commissioner and other concerned parties have been made respondents in the writ. The writ petition seeks a ruling on why the decision to assign the deputy commissioner and upazila nirbahi officer as returning officer and assistant returning officer instead of District and upazila Eeection officers in elections is not illegal.
The writ further states that the Election Commission will conduct the elections in accordance with the constitution and the Executive Branch will provide all cooperation to the Election Commission. But the responsibility of conducting every election is given to the Executive Branch in violation of the constitution.
The Executive Branch, as the representative of the government, conducts elections according to the needs of the government. As a result, various controversies have arisen regarding the elections.
