Law Advisor Asif Nazrul said the interim government is embarrassed about case trading and false cases and the law is being amended to save the people from it.
“In this way, if there is no evidence based on the primary investigation report, the court will be able to release the accused before the trial begins,” he said.
Asif Nazrul said this while talking to the reporters at the Foreign Service Academy in the capital on Sunday afternoon. This press conference was organized to inform the decision of the Advisory Council meeting. The Chief Advisor's press secretary Shafiqul Alam was present at the time.
While informing about the decision of the Advisory Council, the Legal Advisor said, “A very important amendment to the Criminal Procedure Code was made in today's meeting. We ourselves are very embarrassed; we try to inform everyone about it. One of them is filing fake and false cases, another is filing false cases, that is, maybe the case is correct but there is a kind of case trading by accusing many people in the case. We have tried many times to get rid of that. After talking to all the reputed lawyers in Bangladesh and consulting many people, we have made an important change in the CrPC.”
Asif Nazrul said, “When a murder case is filed, it takes two to four years to investigate it. In some cases, there is a kind of case trading. Those who are accused here are in a state of fear for several years that when they will be arrested or whether the case will be traded or not. To get rid of that, we have made a new provision. This new provision states that if the police commissioner, Police Superintendent or any police officer of the rank of Police Superintendent thinks it is reasonable to do so in a case under his jurisdiction, then he can ask the investigation officer to submit a preliminary report on the investigation of the case. When the investigation officer submits that preliminary report, the police commissioner or police superintendent will tell him to submit this preliminary report to the magistrate. After submission, if the magistrate finds that out of 100 people accused in a case, 90 of them are not actually charged, there is no evidence, then the magistrate can immediately release the accused from that case at the trial stage.”
Hoping that this will stop the case-trading, he said, if this amendment comes into effect, the court and the police administration will work together and the court will be able to release ‘victims’ before the trial begins those cases in which arrest-trading or case-trading is taking place, in which numerous people are being accused, against whom no evidence can be found in the preliminary investigation report. As a result, I hope, people will be spared from fake cases. However, that does not mean that the investigation will stop.”
